29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    At 14700 Sport of Kings, Wichita, KS, the employer had not developed a written hazard communication program to address safety handling of chemicals to include proper labeling, handling and safety precautions to be taken for chemicals on-site, such as oil, gasoline, adhesive and asphalt shingles, exposing employees to dermatitis, inhalation hazards and possible eye injury.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder.    At 14700 Sport of Kings, Wichita, KS, employees accessed an 8 in 12 sloped portion of the roof with a ladder that did not extend 3 feet above the eave and the ladder was not secured at its top, exposing employees to a fall of approximately 12 feet to the ground below.
