29 CFR 1910.157(c)(4): Portable fire extinguishers were not maintained in a fully charged and operable condition:    (a) Sugar Ridge, Inc. on or about February 5, 2013, at the address of 41850 Oberlin Elyria Rd. Elyria, OH: The employer failed to maintain fully charged portable fire extinguishers in areas designated by the employer. Several discharged units were kept in the location where employees would access them in the event of a fire. Employees were exposed to fire hazards in that, when necessary no serviceable units would be available for use.

29 CFR 1910.252(a)(1)(i): When the object to be welded or cut could not be readily moved, all movable fire hazards in the vicinity were not taken to a safe place:    a)  Sugar Ridge, Inc. on or about February 5, 2013, at the address of 41850 Oberlin Elyria Rd. Elyria, OH: The employer failed to ensure gas fuel tanks removed from salvaged automobiles were moved away from the vicinity of metal torching/cutting operations. Employees performing this work within 25 ft. of the used fuel tanks were exposed to fire hazards.

29 CFR 1910.253(b)(2)(iv): Valve protection caps, where cylinders were designed to accept caps, were not always in place, hand-tight, except when cylinders were in use or connected for use:     a)  Sugar Ridge, Inc. on or about February 5, 2013, at the address of 41850 Oberlin Elyria Rd. Elyria, OH: The employer failed to ensure the valve cap on a compressed oxygen cylinder was on the tank while in storage/not in use. Employees working in the area were at risk of serious injury in the event the unsupported tank overturned, dislodging the valve assembly and creating a violent release.

29 CFR 1904.29(a): The employer did not use an OSHA 300, 301 and 300A Form or equivalent.    a)  Sugar Ridge, Inc., following a work place injury in December 2012, the employer failed to record the incident on an OSHA 300 or equivalent form for the calendar year of 2012. Without a copy of the logs the Department of Labor has no way to accurately verify injuries or illness during this time period.
