29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. The employer does not protect employees from cave-ins when working in excavations. This violation was observed on or about January 30,2013, at the excavation site where employees were exposed to a struck by hazard while connecting an apartment's sewer lines to the city of Houston's sewer system. Employees were working in an excavation that was 6 foot 6 inches deep without a properly designed benching system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that maximum allowable slopes and allowable configurations for sloping and benching systems are determined in accordance with Appendices A & B of this subpart when constructing protective systems for excavations five foot or more in depth.
