29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about February 6, 2013, while working at an excavation site, daily inspections of an open trench were not conducted prior to employees entering the trench to conduct work, exposing the employees to the hazard of being crushed by the soil.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about February 6, 2013, while working at an excavation site, no protective devices, effective benching or sloping were in place to protect employees as they accessed/egressed from a trench, exposing the employee to the hazard of being crushed by collapsing soil. MICHELS CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315562769, CITATION NUMBER 1, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 6, 2012, WITH A FINAL ABATEMENT DATE OF JANUARY 18, 2012, WITH RESPECT TO A WORKPLACE HAZARD OFF I-44, ½ MILE NORTH OF STROUD EXIT IN STROUD, OK 74079.
