29 CFR 1926.300(b)(2):  Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:    a)   At the site at 621 Water Street, Webster, TX:  On February 7, 2013 the employer failed to guard moving parts of the gasoline powered mortar mixing machine, including rotating belt and pulley, rotating gear sprockets, and the rotating mixing arm exposing employees to injury or amputation from caught by hazards.

29 CFR 1926.451(f)(7):   Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.    a)  At the site at 621 Water Street, Webster, TX:  On February 7, 2013 the employer did not ensure the scaffold in use by employees conducting residential masonry was erected by experienced employees trained by a competent person qualified in scaffold erection.  The scaffold as erected had numerous deficiencies including but not limited to missing guardrails on a working level of 13 feet, working levels not fully planked, missing cross braces, cross braces not connected, missing base plates, and improper loading of leg support structure, exposing employees to a fall or collapse hazard at a height of approximately 13 feet, 3 inches above a lower level.

29 CFR 1926.403(b)(1):   Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:    a)  At the site at 621 Water Street, Webster, TX:  On February 7, 2013 the employer provided a portable cable with several hazardous electrical conditions for use on the site, including a severed ground wire, exposed conductors due to lack of strain relief, and an interior use 110 volt outlet box being used outdoors in wet conditions with no cover, exposing employees to electrical shock and electrocution hazards.
