29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    On or about February 06, 2013 at a workplace located at 4801 Marine Creek Parkway, Fort Worth, Texas; at least three employees were not provided a safe means of egress from a 7 to 9 foot deep trench excavation.  The employees were observed climbing up and down the north wall to enter and exit.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    On or about February 06, 2013 at a workplace located at 4801 Marine Creek Parkway, Fort Worth, Texas; employees who were working in a 7 to 9 foot deep trench excavation that was not benched, sloped or shored, were exposed to the hazard of a cave-in.
