OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a machine guarding hazard: Inside of the Production Department, an employee operating the Cram-A-Lot vertical baler, m/n DXR-42-C, s/n BDO2589-08, was not instructed in the safe work methods as described by the manufacturer. Training records identifying the names of the employees and the date of instruction were not maintained. One method of abatement to correct the apparent hazard is to provide to employees instruction and training in safe work methods, including procedures provided by the manufacturer, before assigning them to operate the baler as required by ANSI 245.5-2004, paragraph 7.1.b.
