On or about February 6, 2013, the single section of tubular scaffold did not have cross braces installed on the inner and outer legs exposing the employee working from the scaffold platform to a fall hazard.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, shall not be used on top of scaffold platforms to increase the working level height of employees. (a). On or about February 6, 2013, stacked blocks and a plank was used as an elevated surface on the platform of the scaffold to allow the employee to reach a higher working level exposing him to a fall hazard.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a). On or about February 6, 2013, the employee working from the scaffold section was not protected by personal fall arrest or a guardrail system to safeguard him from a 7 foot fall hazard.
