29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    Frequent and regular inspections were not being performed by a competent person at Airway Construction Co. from the start of the renovation of the existing two story brick building at 3309 Office Park Drive, Kettering, on November 27, 2012.

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a two story brick office building under renovation, an employee was exposed to a 20 foot fall hazard when he went up onto the low slope roof to show roofers where he had pre-drilled holes to mark the location of elevator shaft opening and was not protected by any fall protection system.

29 CFR 1926.503(a)(1):     The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a renovation of an existing two story brick building, an Airway Construction Co. employee who walking to a location near the edge of the low slope roof without utilzing any fall protection had not received any training on recognizing fall hazards and on the procedures to follow in order to minimize these hazards.
