29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  On or about February 6, 2013, at the worksite located at 14004 Foxfield Lane in Little Rock, Arkansas, a Hazard Communication Program had not been developed for the benefit of employees using and/or exposed to hazardous chemicals/ingredients such as but not limited to portland cement, crystalline silica and hexavalent chromium contained in the Argos Type N Custom Blended Masonry Cement being mixed and used by employees performing masonry application tasks.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  On or about February 6, 2013, at the worksite located at 14004 Foxfield Lane in Little Rock, Arkansas, an excessive amount of wooden boards, bricks and other debris were scattered on the ground.  This condition exposed employees to the hazard of falls from the same elevation.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  On or about February 6, 2013, at the worksite located at 14004 Foxfield Lane in Little Rock, Arkansas, on the supported scaffold on the east side of the home being built, the 2nd level platform that employees worked from performing masonry activities was not decked the full width of the scaffold.  This condition exposed employees to an approximately 13 ft. fall from elevation.

This condition exposed employees to an approximately 13 ft. fall from elevation.

This condition exposed employees to falls from elevations.

This condition exposed employees to falls from elevation and/or a scaffold collapse.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:  On or about February 6, 2013, at the worksite located at 14004 Foxfield Lane in Little Rock, Arkansas, on the supported scaffold on the east side of the home being built, employee dismounted from the 2nd level platform at the approximately 13 ft. level and climbed down the cross bracing to lower to ground level.  This condition exposed employees to the hazard of slips and falls from elevation.

Employees were exposed to an approximately 13 ft. fall from elevation.
