OSH ACT of 1970 Section (5)(a)(1); The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing, or likely to cause, death or physical harm to employees in that an employee was overexposed to asphalt fumes which can cause health effects such as but not limited to eye and throat irritation, skin lesions and cancer.   On or about February 7, 2013, while applying roofing material at the above addressed jobsite, an employee was exposed to asphalt fumes at an 8-hour Time Weighted Average concentration of 1.5 mg/m3. The employee was sampled for 381 minutes with zero dose assumed for the 99 minutes of un-sampled time. The ACGHI Threshold Limit Value for asphalt fumes is 0.5 mg/m3.
