29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: At the job site, on February 7, 2012, an employee was operating a Genie Telehandler Model GTH 636 Serial Number GTH0607A-10570 and was not wearing a proper personnel protective equipment PPE (seat belt), exposing him to the hazard of being ejection from the forklift.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: At the job site, on February 7, 2013, Employees were accessing scaffolding by use of the frame, as no ladder was installed, exposing employees to falls from height.
