29 CFR 1926.651(j)(2):   Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary  On or about February 6, 2013, and other times prior, at this excavation project, employees worked in trenches where the spoil pile was not placed at least 2 feet away from the edges of the trenches. Employees were exposed to being struck by spoil pile material falling or rolling into the work areas inside the trenches.

29 CFR 1926.652(a)(1):   Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):  On or about February 6, 2013 and other times prior, at various points on this project, employees worked in trenches up to 20 ft. long by 8 ft. wide by 9 ft. without cave-in protection. Employees worked in trenches where the dirt walls of the trenches were nearly vertical and were not equipped with adequate sloping, an adequate trench box/shield, or other support/shoring equipment. Employees were exposed to cave-ins.
