29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: (a) On February 6, 2013, at the facility located at 2103 W Vista, Springfield, MO., the employer did not ensure that the Powered Industrial Truck Operator for the facility had a current certification to operate the equipment, in that the last performance evaluation had expired on September 26, 2009. Employees were exposed to serious injuries due to not conducting the revaluation per the instructions of the standard. Abatement certification for this violation is not required.
