29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: The employer did not ensure that each employee in the cabs of motor vehicles and material handling equipment was restrained by a seat belt. The violation most recently occurred on February 7, 2013, at a workplace located at 3820 Sam Rayburn Highway, Melissa, TX 75454; where employees operated Komatsu, HM400-2, articulated dump trucks without wearing a seat belt and were exposed to hazards causing or likely to cause death or serious physical harm.

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it is safe: The employer did not inspect rigging equipment for material handling during its use to ensure that it was safe. This violation occurred on February 8, 2013, at a workplace located at 3820 Sam Rayburn Highway, Melissa, TX 75454; where the employer, by not inspecting rigging equipment during its use, used synthetic-fiber web slings with an excavator to move materials and did not protect the slings from corners, edges, protrusions and abrasive surfaces of the bucket and teeth. Employees were exposed to struck-by and crushed-by hazards.
