29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition): (a) On or about February 8, 2013, and at times prior to that date, employees were exposed to struck-by hazards presented by vehicular traffic in that, the employer did not utilize proper flagging/signaling procedures, in that employees were observed crossing the street in the live lane, in front of the flagger, without first stopping traffic.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) ; (a) On or about February 8, 2013, and at times prior to that date, employees working in an approximately 8 foot deep excavation were exposed to a cave-in hazard. Note: Concrete Works of Colorado was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 314663584, Citation 1, Item 1 issued May 2, 2011 with respect to a workplace located at the intersection of Arapahoe Street and 14th Street, Denver, CO. This citation became final on May 25, 2011.
