29 CFR 1910.147(c)(1):  The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a)  At the worksite, on February 7, 2013, the employer an energy control program had not been developed and implemented.  Employees perform maintenance activities on equipment such as, but not limited to, the 25 ton press break and the 10 ton punch press referred to as 'Robby.'  This condition exposed employees to struck-by, crushing and amputation hazards.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    a)  In production area, on February 7, 2013, employees used the 25 ton mechanical press brake (unknown serial number and model number) to attach rivets to brackets.  The press brake was not equipped with a guard to prevent employees from entering the point of operation, exposing employees pinch points.      b)  In the production area, on February 7, 2013, an employee used the 10 ton punch press (unknown serial number and model number), referred to as 'Robby' by the employer, to punch holes into brackets.  The punch press was not equipped with a guard to prevent employees from entering the point of operation, exposing employees to pinch points.    c)  In the production area, on February 7, 2013, an employee used the Tru-Cut roll former machine number 964R to form and cut shutters.  The points where the product enters and exits the machine was not guarding to prevent employees from entering the point of operation, exposing employees to pinch points.     d)   In the production area, on February 7, 2013, an employee used the Tru-Cut roll former machine number 965R to form and cut shutters.  The points where the product enters and exits the machine were not guarded to prevent employees from entering the point of operation, exposing employees to pinch points.
