29 CFR 1926.453(b)(2)(v):     A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.      a) 10770 US Hwy 287 Three Forks, MT 59752 grain silos: On or about February 8, 2013 and at times prior thereto, two employees were using an aerial lift to access the top of the grain silos. The employees did not have their lanyards attached to an anchor point while using the aerial lift and were exposed to a fall of over 40 feet if the employees were to be ejected from the aerial lift.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) 10770 US Hwy 287 Three Forks, MT 59752 grain silos: On or about February 8, 2013 and at times prior thereto, employees were working on top of grain silos that were over 40 feet above the ground below. The employer did not ensure that employees were protected from a fall while replacing the grain transfer system.

An employee was using a body belt as part of his personal fall arrest system. The employer did not ensure that employees did not use body belts as part of their personal fall arrest system.

29 CFR 1926.502(d)(23):     Personal fall arrest systems were attached to guardrail systems or to hoists:    a) 10770 US Hwy 287 Three Forks, MT 59752 grain silos: On or about February 8, 2013 and at times prior thereto, employees were replacing the grain transfer system that was over 40 feet above the ground below. The employees were attaching their lanyards to the guardrail on top of the silos. The guardrail system was made out of rebar that was welded to metal straps. The employer did not ensure that employees had an adequate anchor point while working on top of grain silos.

The employer did not train each affected employee on when PPE is necessary; what PPE is necessary; how to properly don, doff, adjust, and wear the PPE and the limitations of the PPE.
