29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: 1) On February 7, 2013, Regency Residential Partners, LLC. as the controlling employer, did not ensure that employees of its sub contractor, CME Construction, were protected from falls at Building 1 in the following instances: a) Where guardrails were not installed on the unprotected edge next to the ladder that employees used to access the second floor. b) Where employees were sitting a wall on the 3rd floor and were not protected by guardrails, safety net sytems, or personal fall arrest systems.
