Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls.        a.  Feed Mill - An employee was elevated in a forklift supported man basket that was not secured to the forks thereby exposing the employee to falls of up to 14 feet.

29 CFR 1910.24(f): "Stair treads." Rise height and tread width were not uniform throughout any flight of stairs including any foundation structure used as one or more treads of the stairs.  a.  Feed Mill  - The stairway connecting the second and third levels was not constructed and used with uniform tread and riser height throughout thereby exposing employees to slip, trip and fall hazards of up to 22 feet.

29 CFR 1910.24(h): "Railings and handrails." Standard railings shall be provided on the open sides of all exposed stairways and stair platforms. Handrails shall be provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails shall be installed in accordance with the provisions of 1910.23.  a. Feed Mill - The stairway connecting the second and third level mill platforms was not equipped with standard handrails on all open sides.

29 CFR 1910.178(q)(7): Where industrial trucks were used around-the-clock, they were not examined after each shift.    Defects when found were not immediately reported and corrected:    a. Feed Mill - The Terex rough terrain forklift was used with a safety defect in that the right side rear view mirror was broken thereby exposing employees to potential crushing hazards.

All areas designated as hazardous (classified) locations under the Class and Zone system and areas designated under the Class and Division system established after August 13, 2007 shall be properly documented. This documentation shall be available to those authorized to design, install, inspect, maintain, or operate electric equipment at the location.     a. Feed Mill  area - The electrical service equipment used in the Class 2 Division 2 area did not have documentation showing the design, installation, inspection and operation characteristics of such equipment.

29 CFR 1910.307(c): Electrical installations. Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. Requirements for each of these options are as follows:   a.  Feed mill operators station - The plug box used at the station was not rated for a Class 2 Division 2 location thereby exposing employees to potential fire hazards.   b.  Feed mill operators station - The cable tray used above the operators station was not installed and rated for a Class 2 Division 2 location thereby exposing employees to fire hazards.
