29 CFR 1910.132(d)(1):     The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    a) Kitchen at 11 Highway 10, Park City, Montana 59063:  On or about February 4, 2013 and at times prior thereto, Employer did not conduct a hazard assessment of the work place to determine the Personal Protective Equipment requirements for working with chemical liquids such as but not limited to; Advanced Chemical Technology Inc. Vegetable Wash, ProForce No Rinse Floor Cleaner Concentrate, ProFroce Heavy Duty Degreaser Concentrate, ProFroce Pink Lotion Dish Detergent Concentrate, ProForce Lemon Fresh Disinfectant Cleaner, and ECO Suds Concentrated Liquid Cleaner for Manual Warewashing.

29 CFR 1910.1200(e)(1):     Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    a) Smoke N Antlers BBQ Cafe:  On or about February 4, 2013 and at times prior thereto, employees were exposed to ingestion, absorption and inhalation hazards while using chemicals such as but not limited to; Advanced Chemical Technology Inc. Vegetable Wash, ProForce No Rinse Floor Cleaner Concentrate, ProFroce Heavy Duty Degreaser Concentrate, ProFroce Pink Lotion Dish Detergent Concentrate, ProForce Lemon Fresh Disinfectant Cleaner, and ECO Suds Concentrated Liquid Cleaner for Manual Warewashing without a Hazard Communication Plan that addressed the issues of labeling containers, providing Materila Safety Data Sheets, Personal Protective Equipment and training of the employees concerning the plan.
