OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious body and head trauma:     On or about February 11, 2013, an employee was observed riding in the back of the pick-up truck while the truck was traveling. The employee was not secured by a seat belt or other means of restraint to prevent him from being ejected or falling from the vehicle in case of sudden stops or turns. Further enhancing the hazard was the fact that snow and ice was allowed to accumulate in the truck bed which created a greater possibility of slipping and falling out of the truck.
