29 CFR 1910.178(l)(1)(i):  The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Ruben Otto dba Springhaven Enterprises had an employee operate a powered industrial truck, and the employer did not provide powered industrial truck operator training, as specified by paragraph (l).  This training would include the following:     a.	Formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material),  b.	Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee),  c.	Evaluation of the operators performance in the workplace.

The employer did not have an effective safety and health program with specific work rules, competent person oversight, and employee training to govern employees activities.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. The employer did not provide construction safety training to employees, in order to provide them with the knowledge necessary to recognize the hazards of falling and the safety requirements associated with fall protection, as well as the proper work procedures to follow, in order to minimize and eliminate the fall hazards.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.    Ruben Otto dba Springhaven Enterprises had employees exposed to 18 ft. fall hazards while climbing down from the roof on the structure of the building, on a commercial construction site in Mattoon, IL.  The employer did not provide construction safety training to employees, in order to provide them with the knowledge necessary to recognize the hazards related to ladders, as well as the proper work procedures to follow, in order to minimize and eliminate theses hazards.  This training would include:    a.	The nature of fall hazards in the work area,   b.	The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used,  c.	The proper construction use, placement, and care in handling of all ladders,  d.	The maximum intended load carrying capacities of ladders, and   e.	The standards contained in this subpart, Subpart X  Stairways and Ladders.
