29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. (a) On or about February 12, 2013, there was no ground-fault circuit-interrupter protection or an assured equipment grounding conductor program when extension cords were used to power a 110 VAC Makita circular saw. Employees used the saws to cut lumber and rebar.

29 CFR 1926.405(b)(2): In an energized installation, each outlet box did not have a cover, faceplate, or fixture canopy. (a) At the project site on or about February 12, 2013, there was no cover/face plate on the outlet that powered extension cords used to power a 110 VAC Makita circular saw, model 5007N and Makita portable cut off saw, model 2416S.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws: (a) At the project on or about February 12, 2013 and at times prior thereto, the outer insulation of the Makita cut off saw, model 2416S, was not secured to the plug. Employees used the cut off saw to cut rebar.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) At the project on or about February 12, 2013 and at times prior thereto, employees were not protected against excavated materials that could pose a hazard by falling or rolling into the trench. Spoil material was not placed at least 2 feet away from the edge of the trench.
