29 CFR 1910.38(d): The employer did not have and maintain an employee alarm system with a distinctive signal for each purpose so that it complied with the requirements of 1910.165: a) On or about Februrary 7, 2013 and times prior in the boiler room: The employer failed to ensure an alarm system was installed and maintained in the boiler room (now ammonia room) which has four separate ammonia systems, each charged to around 300 pounds and one charge system cylinder with about 150 pounds of Ammonia - NH3 used for refrigeration. Employees going into the room daily to check readings and pressure which expose them to the hazards of overexposure of ammonia gas.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: a) On or about February 7 2013 and times prior, the bench grinder tongue guard: The employer failed to ensure the tongue guard on the Wissota model E-33 was properly adjusted to within 1/4 inch of the wheel which exposed employees to the hazards associated with being struck-by material or broken wheel pieces.
