OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to rollover and/or struck by hazard(s) while operating ATVs and/or Front end Loaders:    a) Jobsite: On or about February 6, 2013, and at times prior thereto, the employer did not ensure employees had been trained, were qualified, and safely operated All-Terrain Vehicles (ATVs) including, but not limited to, use of seatbelts, appropriate speeds, operating surfaces, emergency braking and maneuvers, tire pressures, and driving behavior.     b) Jobsite: On or about February 6, 2013, and at times prior thereto,m the employer did not endsure employees utilized their seatbelts while operating the front end loader.    Note) Abatement certification IS required for this item.
