OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards.  In the Tractor Maintenance Building employees were exposed to fire and explosion hazards as the oxygen cylinders  were located adjacent to the acetylene cylinders and separated by a sheet of cardboard in the storage rack.  AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE:  A) Separate stored oxygen and fuel gas cylinders by a minimum of 20 feet. [CGA Pamphlet P1-1965]  B) Separate stored oxygen and fuel gas cylinders  at a minimum, by a firewall of five (5) feet high with a fire rating of thirty (30) minutes. [CGA Pamphlet P1-1965]

29 CFR 1910.1200(e)(1): This provision is applicable to agricultural employment by 1928.21(a)(5).   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  A written hazard communication program was not available upon agency request. Employee(s) were exposed to chemicals including, but not limited to antifreeze, hydraulic fluids, spray paints, and welding gases.

The employer did not train employees on the physical and health hazards of the chemicals in the work area.  Employees had not been trained on physical and health hazards from the chemicals they used or were exposed to in the farm and truck maintenance shops.  Employee(s) were exposed to chemicals including, but not limited to antifreeze, hydraulic fluids, spray paints, and welding gases.

29 CFR 1910.1200(g)(8):  This provision is applicable to agricultural employment by 1928.21(a)(5).   The employer did not maintain in the workplace copies of the required material safety data sheets for each hazardous chemical, and ensure that they were readily accessible during each work shift to employees when they are in their work area(s).  Material safety data sheets (MSDS) for chemicals including, but not limited to acetylene and parts washer solvent were not available upon agency request. Employee(s) were exposed to acetylene and parts washer solvent in the farm and truck maintenance shops.
