29 CFR 1910.138(b):     The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified:    On or about February 12, 2013 and times prior thereto, employees of Adko, Inc. manufactured cutting dies with rule in the cutting die facility located at 6901 Jenny Lind Road in Fort Smith, Arkansas.  The employees were not using appropriate hand protection when handling rule for die application, exposing the employees to cuts.

29 CFR 1910.215(a)(4):     Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch.    On or about February 12, 2013 and times prior thereto, an employee of Adko, Inc. was observed using a Baldor bench grinder with model number 712RE and serial number 07-302-30 in the rule and rubber area in the cutting die facility located at 6901 Jenny Lind Road in Fort Smith, Arkansas.  The employee used the bench grinder to grind rubber and rule as needed for application onto the die.  The work rests of the grinding machine were adjusted with an opening from the wheel of greater than one eighth inch.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    On or about February 12, 2013 and times prior thereto, employees of Adko, Inc. performed cutting die and printing plate manufacturing with the use of chemicals such as but not limited to inks and glue.  The employer had not developed and maintained a written hazard communication program.

29 CFR 1910.1200(f)(5)(i):     The employer did not ensure that each container of hazardous chemicals in the workplace were labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:    On or about February 12, 2013 and times prior thereto, employees of Adko, Inc. used chemicals such as but not limited to glues and inks for the manufacture of cutting dies and printing plates.  Two instances were observed of chemicals being used in the employer's workplace located at 6901 Jenny Lind Road in Fort Smith, Arkansas in unlabeled containers.  The instances observed were as follows:    a)  Employees used various glues for the application of rubber onto dies being manufactured in the rubber department of the cutting die manufacturing facility.  The containers which the glue had been transferred into by employees did not have labeling to identify the substance held.    b)  Employees used various colors of inks for the manufacture of printing plates in the printing press area of the graphics design division.  The containers which the inks had been transferred into by employees did not have labeling to identify the substance held.
