29 CFR 1910.335(b)(1):  Safety signs, safety symbols, or accident prevention tags were not used where necessary to warn employees about electrical hazards which may endanger them, as required by 1910.145:        a) PMA Mill Motor Electrical Disconnect: On or about February 11, 2013, and at times prior thereto, employees were exposed to potential electrical arc flash hazards, while examination, adjusting, servicing, and maintaining energized equipment such as but not limited to, the EATON Motor Circuit Protector (MPC), Cat.HMCP400Y5C.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:     a) PMA Mill: From February 07, 2013 through February 11, 2013, employees working in and around the Polymer Modified Asphalt (PMA) Mill area were exposed to arc flash and fire hazards as a result of the misapplication of the EATON Motor Circuit Protector (MCP), Cat. HMCP400Y5C when the employer altered the (MCP) to prevent it from functioning as designed.   The employer removed the cover to the MCP and wedged a piece of wood into the tripping mechanism.

29 CFR 1910.304(f)(1)(i): Conductors and equipment were not protected from overcurrent in accordance with their ability to safely conduct current:     a) PMA Mill: From February 07, 2013 through February 11, 2013, employees working in and around the Polymer Modified Asphalt (PMA) Mill area were exposed to arc flash and fire hazards when the employer altered the EATON Motor Circuit Protector (MCP) to prevent it from functioning as designed to interrupt current flow when a fault condition is detected in the PMA Mill electric motor.  The employer removed the cover to the MCP and wedged a piece of wood into the tripping mechanism.

29 CFR 1910.303(e)(1)(ii): Electrical equipment was used when the markings giving voltage, current, wattage, or other ratings as necessary were missing:   a) Electrical Box #2508: On or about February 11, 2013 and at times prior thereto, the employer failed to ensure electrical ratings were marked on the switch for the pump identified asTK130.   b) Electrical Box #2507: On or about February 11, 2013 and at times prior thereto, the employer failed to ensure electrical ratings were marked on the switch for the pump identified asTK132.   c) Electrical Box #2506: On or about February 11, 2013 and at times prior thereto, the employer failed to ensure electrical ratings were marked on the switch for the pump identified asTK133.   d) Electrical Box #2505: On or about February 11, 2013 and at times prior thereto, the employer failed to ensure electrical ratings were marked on the switch for the Wet Tank Mixer.   e) Electrical Box #2504: On or about February 11, 2013 and at times prior thereto, the employer failed to ensure electrical ratings were marked on the switch for the Screw Conveyor.
