29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides. a) Job Site, 88 Ramland Road, Orangeburg, NY: Employees walked on the stacked metal shelves to retrieve merchandise, approximately 17 feet above a lower level. The shelves were not provided with railings on open sides, on or about2/12/2013.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee was exposed to the hazard of falling: (A) Job site, Warehouse; On or about February 12, 2013, an employee operated a CrownTurret Stockpicker in order to pick up a box containing an electronic projector. The employee left the Turret stockpicker platform while it was elevated approximately 17' above the floor below. While the side gate was open, the employee stepped on the shelving platform, not wearing a harness and tether. Among other methods, feasible and acceptable abatement methods to correct this hazard are: 1) Follow the operators manual, page 21- platform safety; were it states not to leave the Turret Stockpicker platform when it is elevated and to use the harness and tether whenever you are working from a raised platform and have the side gate open. 2) Follow the Safety standard for low lift and hight lift trucks, ANSI B56.1 2005, Part II for the user section 5.2. 24 (R), which indicates restraining means such as rails, chains, etc. should be in place, or persons on the work platform shall wear a body, harness and lanyard or retractable safety device.
