29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    The employer does not ensure that employees use eye protection when operations present the potential of eye injury. This violation was observed on or about February 13, 2013, at the construction site when an employee was exposed to a struck-by hazard while using an air nailer to hang insulation panels without wearing eye protection.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are provided with and required to wear required personal protective equipment.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    The employer does not ensure that a guardrail system is installed on all working levels of scaffolds to prevent employee injury. This violation was observed on or about February 13, 2013, on the west side of a home being constructed when an employee was exposed to a fall hazard while on the working level of a pump jack scaffold without a guardrail system in place.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed and maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

29 CFR 1926.452(j)(1):  Pump jack brackets, braces, and accessories were not fabricated from metal plates and angles. Each pump jack bracket did not have two positive gripping mechanisms to prevent any failure or slippage:    The employer does not ensure that all braces used to support pump jack scaffolds are made from metal plates to prevent employee injury. This violation was observed on or about February 13, 2013, on the west side of a home being constructed when an employee was exposed to a fall hazard while on the working level of a pump jack scaffold without metal braces to support the aluminum pole to the top of the building.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed and maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary:    The employer does not ensure that poles are secured to the structure using rigid triangular bracing at the bottom of the scaffold to prevent employee injury. This violation was observed on or about February 13, 2013, on the west side of a home being constructed when an employee was exposed to a fall hazard while on the working level of a pump jack scaffold without bracing to support the aluminum pole to the bottom of the building.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed and maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.
