29 CFR 1926.501(b)(13): Employer did not provide each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels with fall protection by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    The employer does not ensure that employees engaged in residential construction activities 6 feet or more above lower levels are provided with a fall protection system. This violation was observed on or about 14-february 2013 at the construction site where employees were exposed to an approximate 34 foot fall hazard when performing roofing work without a fall protection system.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities are protected from falling when exposed to falls 6 feet or more above a lower level.

29 CFR 1926.1053(b)(1): When portable ladders were used to access the upper landing surface and the ladder(s) length allows, the ladder side rails did not extend at least 3 (9 m) feet above the upper landing surface to which the ladder was used to gain access.      The employer does not ensure that ladder used by employees is extended 3 feet above the upper landing surface. This violation was observed on or about February 14, 2013 at the construction site where employees were exposed to an approximate 14 foot fall hazard when using a ladder that its side rails did not extend to at least 3 feet above the upper landing surface to which the ladder was used to gain access to roof .    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extended at least three feet above the upper landing surface and is secured its top to a rigid support.
