29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  The employer does not ensure that employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system.  This violation was observed on or about August 06, 2014 at the construction site where employees were exposed to fall hazards when performing roofing work 6 feet or more above a lower level without a fall protection system.   Lucino Gomez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 887283, citation number 1 item number 1 and was affirmed as a final order on May 07, 2013 with respect to a workplace located at Cypresswood and Duke Lake, Spring, TX, 77388.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities are protected from falling when exposed to falls 6 feet or more above a lower level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  The employer does not ensure that where portable ladders were used for access to an upper landing surface, the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface.  This violation was observed on or about August 06, 2014 at the construction site where employees were exposed to fall hazards when performing roofing work 6 feet or more above a lower level when using a ladder whose side rails did not extend at least 3 feet above the upper landing surface.
