29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.     (a) At the project site, on or about February 15, 2013, employees were not instructed in the recognition and avoidance of unsafe conditions of being struck by the rotating superstructure of the Hitachi 470 excavator, No. 2, and the carrier. Precautions (e.g., erect barricades, warning lines, or other excavation industry recognized procedures) to prevent entry into a swinging superstructure's radius was not communicated at the work site. Employees near the excavator were exposed to struck by hazards from the rotating superstructure.

29 CFR 1926.403(h):     Each service, feeder, and branch circuit was not legibly marked at its disconnecting means or overcurrent device to indicate its purpose, nor located and arranged so that the purpose was evident:    (a) At the construction worksite's main temporary power supply located near the rebar fabrication area, on or about February 15, 2013, each branch circuit was not marked to indicate their purpose or location, exposing employees using electrical equipment and tools to electrical hazards.
