29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about February 13, 2013 at the above addressed site, the employer did not ensure that the operator of a rough terrain forklift was competent to operate that lift by the successful completion of a training and evaluation program.

29 CFR 1926.451(c)(2)(iv):  Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about February 13, 2013, at the above addressed site, a rough terrain forklift was used to support a job made wooden box that was not specifically designed by the manufacturer for such use while employees worked from it, unloading their tools at approximately 29 feet above the lower level.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  On or about February 13, 2013 at the above addressed site, employees performing work unloading tools from a wooden box to a walking/working surface with unprotected edges approximately 29 ft. above a lower level, were not protected from falling to that lower level.
