29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: The employer does not protect employees in an excavation from cave-ins by an adequate protective system. This violation was observed on or about February 14, 2013 at the jobsite where employees were exposed to a crushed-by hazard when working in an excavation that was 5 feet 4 inches in depth that had no protective system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including the steps that it is taking to ensure that employees are protected from cave-ins while working in an excavation.
