29 CFR 1926.201(a): The use of flaggers, signaling by flaggers or the warning garments worn by flaggers did not conform to Part IV of the manual on Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA, which are incorporated by reference: a) The violation was most recently observed on or about February 15, 2013, on N. Lehigh Ave., at or about W. Howard Str., where the employees were exposed to the hazard of being struck by moving vehicles while performing flagging tasks within an active roadway without sign paddles or flags to safely transfer vehicular traffic, as required by the Part VI of the MUTCD 1988 Edition, Section 6E-4. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) Employees were not protected from the hazard of cave-in while working in a trench measuring approximately 7.2 feet in depth. The A-1 Sewer and Water Contractors, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 242701, citation number 1, item number 2 and was affirmed as a final order on April 10, 2012, with respect to a workplace located at 6908 Church Str., Morton Grove, IL 60053. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
