29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. On the site the employer did not provide training in trenching and excavating for employees who were working in trenches thereby exposing employees to a cave-in hazard. b. On the site where work was performed on the side of the roadway, the employer did not provide training in road contruction set-up, inspecting and maintaining a road zone with a closed lane thereby exposing employees to a struck-by hazard.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. In the trench where employees were installing sections of 12 inch water line in a 7 foot deep trench, the employer did not provide a safe means of entering and exiting the trench thereby exposing employees to a cavein hazard.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a. In the south trench where employees were working in a 7 foot trench installing 20 foot sections of 12 inch pipe, the employer placed the spoil pile directly next to the side of the trench thereby exposing employees to a cave-in hazard. b. In the north trench where an employee was locating and connecting a tap in a five foot deep trench, the employer did not provide trench protection such as, but not limited to a trench box thereby exposing an employee to a caught-in hazard.

In the north trench where an employee was locating and connecting a tap, the employer did not provide a protective system when the employee was working in the 5 foot trench thereby exposing the employee to a struck-by hazard.
