29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      a)  On or about February 15, 2013, the employer did not have a lock out program for the control of the hazardous energy, which includes machine specific procedures, training, and periodic inspections, while performing maintenance, servicing, clearing or unjamming on Cumberland 37F Hog Grinder.  Failure to lock out this machine while these tasks are being performed exposes employees to amputation, caught in hazards.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      a)  On or about February 15, 2013, the employer did not develop a written hazard communication program to describe how labels and other forms of warning shall be utilized and how employee information and training on the hazardous chemicals in the work place would be accomplished. The employer has hazardous products such as, but not limited to, hydraulic fluid.  The employer uses hydraulic fluid when performing forklift maintenance.

29 CFR 1910.1200(g)(8):     The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical.    a)  On or about February 15, 2013, the employer did not have safety data sheets in the workplace for the hazardous products such as, but not limited to, hydraulic fluid.  The employer uses hydraulic fluid when performing forklift maintenance.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a)  On or about February 15, 2013, the employer did not provide information and training to employees in the safe handling and use of hazardous chemicals including, but not limited to, hydraulic fluid.  Employees were not aware of the PPE requirements, first aid measures, and potential health effects of exposure to these products.
