29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a) During the period of October 26, 2012 through February 26, 2013, at the above located workplace, employees were required to work with a Palomar StarLux hair removal system. The employees were exposed to Intense Pulsed Light (IPL).  The employer provided and required the employees to wear a pair Intrgra P Z87.1 safety glasses. The safety glasses had cracks in both side shields and the lenses did not provide the required (ANSI Z136.3) eye protection.

29 CFR 1910.1030(c)(1)(i):  The employer having employee(s) occupational exposure did not established a written Exposure Control Plan designed to eliminate or minimize employee exposure:    a) During the period of October 26, 2012 through February 26, 2013, at the above located workplace, employees were exposed to contaminated needles during Botox procedures. The employer had not established an effective written bloodborne pathogens exposure control plan to eliminate or minimize the employee's exposure.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employee exposure:    a) During the period of October 26, 2012 through February 26, 2013, at the above located workplace, employees were required to work with BD Insulin Syringes with BD Ultra-Fine Needles and BD 3 ml Syringes with BD Precision Glide Needles. These syringes and needles did not have engineered sharps injury protection, and placed the employees at an increased risk of needle sticks. Effective and appropriate sharps with engineered sharps injury protection were commercially available. Employees using the syringes and needles without engineered sharps injury protection were therefore exposed to the hazards associated with blood borne disease.

29 CFR 1910.1030(d)(2)(vii): Contaminated needles and/or other contaminated sharps were bent, recapped, or removed:    a) During the period of October 26, 2012 through February 26, 2013, at the above located workplace, employees were required to recap contaminated needles. Recapping needles placed the employees at an increased risk of needlesticks. Employees were therefore exposed to the hazards associated with bloodborne disease.
