29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a. Shop Area - On or about February 13, 2013, The employer did not conduct noise monitoring to determine the employees exposure levels for employees fabricating granite counter tops:    Employees, who were fabricating (grinding) granite counter tops were exposed to continuous noise at 84.2% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 89.4 dBA. This exposure was observed occurring over a 443 minute sampling period on 2/22/13. A zero exposure was assumed for the 37 minutes not sampled.  The employer did not perform exposure monitoring.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    a.) Shop Area - On or about February 13, 2013, the employer did not establish a baseline audiogram for those employees exposed above the action level who were fabricating (grinding) granite counter tops:  Employees, who were fabricating (grinding) granite counter tops were exposed to continuous noise at 84.2% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 89.4 dBA. This exposure was observed occurring over a 443 minute sampling period on 2/22/13. A zero exposure was assumed for the 37 minutes not sampled.  The employer did not perform audiometric testing.

Unloading Area - On or about February 12, 2013, The employer did not evaluate the competency of the training that the forklift operator had received, including but not limited to; load manipulation, and removing (Unstacking) of slabs of granite prior to the employee unloading slabs of granite from an International flatbed truck.

Unloading Area - On or about February 12, 2013, An employee unloading a flatbed truck with 16 slabs of granite, 8 on each side of an A-frame, weighing approximately 1400 lbs, removed slabs from only one side of the vehicle, resulting in a shifting of the A-frame and the slabs on the opposite side to fall from the vehicle.

Shop Area - On or about February 22, 2013, The employer did not provide approved equipment for wet locations, where an employee was using a Makita wet grinder (186390A) to cut a granite slab while flooding the cutting area with water.
