29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: A)On or about 01/31/2013 two employees were observed engaged in the installation of insulation onto the aluminum framing while operating an aerial lift (model 7B42 4 X 4 Snorkel rented from United Rentals) at the construction of the Marshalls store in Riverview Florida. The employees were not instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to control or eliminate hazards in spite of being exposed to fall hazards of approximately 16 feet.

29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket: A) On or about 01/31/2013 an employee was observed climbing all the rails of the aerial lift (model 7B42 4 X 4 Snorkel rented from United Rentals) at the construction of the Marshalls store in Riverview Florida. The employee was exposed to a fall hazard of approximately 16 feet while installing the insulation onto the aluminum framing at the front of the store.
