29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a)  Machinery throughout the scrap yard; On or about February 14, 2013 and at times prior thereto the employer exposed his employees to potentially hazardous energies in that employees were allowed to perform maintenance and servicing on car crushers, John Deer Skid Steer, John Deere Bobcat, John Deer Track Hoe, bailers, and other equipment without having a lockout program, without being trained in lockout tagout, and with out machine specific lockout tagout  procedures for those machines that require them.

29 CFR 1910.178(l)(1)(i):     The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):      a)  Scrap Yard; On or about February 14, 2013 and at times prior thereto the employer exposed employees to struck-by hazards in that employees were allowed to operate a powered industrial truck without the employer first ensuring the employees were competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation.

29 CFR 1910.253(b)(2)(ii):     Cylinders were not stored in areas to ensure that the cylinders would not be knocked over:    a)  Front of shop; On or about February 14, 2013 and at times prior thereto the employer exposed employees to fire / explosion hazards in that employees were allowed to walk and work in the same area where gas cylinders were stored but were not secured to prevent the cylinders from being knocked over.

29 CFR 1910.253(b)(4)(iii):     Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one half hour:    a)  Front of shop; On or about February 14, 2013 and at times prior thereto the employer exposed employees to fire hazards in that employees were allowed to walk and work in the same area where oxygen cylinders and fuel gas cylinders (propane, acetylene) were stored together without a barrier as required by the standard.
