29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. At the back room of the workplace, on or about February 20, 2013, eye protection was not worn while an employee was using a Makita cordless drill to remove screws from gypsum boards.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: At the back wall of the project site, on or about February 20, 2013, a 36 inch florescent light fixture, designed to be mounted on the ceiling, was hanging down from the ceiling. A tie wire affixed to the ceiling was used to support the weight of the fixture.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures. At the back wall of the project site, on or about February 20, 2013, metal studs and debris were not kept cleared from the path to the working areas.
