29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about February 19, 2013, employees removing light posts from a parking lot were working below the light post and employees using hand tools from an elevated level. Employees were not wearing protective helmets to prevent head injuries from falling or flying objects.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: On or about February 19, 2013, employees removing and relocating parking lot light posts were using a SkyTrak 8042 tele-handler forklift and working from a manufactured work platform that was not attached or secured to the forks of the forklift. Employees were exposed to the hazard of falling approximately 35 feet to the concrete below.
