OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a wire rope: A) Work place, on or about August 22, 2012, an employee used a winch to drag a steel container onto the back of a semitrailer. The container was not raised off the ground using blocks to prevent the container from butting up against the back-end of the trailer as it was being winched up, exposing the employee to a struck-by hazard.
