29 CFR 1910.134(d)(1)(iii):  The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form:  a)  On or about February 13, 2013, an employee was exposed to an inhalation hazard while dry cutting center blocks without utilizing respiratory protection.

29 CFR 1926.95(a):  Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  On or about February 13, 2013, an employee was exposed to a chemical burn while mixing Chemstar Type S Lime and not wearing chemical resistant gloves that would prevent skin contact and the potential for burns.

29 CFR 1926.451(e)(1):  When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used.  Crossbraces shall not be used as a means of access:  On or about February 13, 2013, an employee was exposed to a fall from height hazard of approximately 12 feet to the dirt ground below while access a scaffold, via the scaffold's uprights, to retrieve material/work supplies.

29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about February 13, 2013, an employee was exposed to a fall from height hazard of approximately 12 feet to the dirt ground below while retrieving material/work supplies from the scaffold's work platform which did not have standard guardrails.
