OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards, fracture and crushing injuries: a) Throughout Facility - The employer used a wooden pallet that did not meet the requirements for elevating personnel on a powered industrial vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and require the use of work platform designed to lift personnel in accordance with American Society of Safety Engineers (ASME), B56.1-2005 Safety Standard for Low and High Lift Trucks, Section 4.17.
