29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)(13):      a) 4630 Gloria Drive, Austell, Ga., On the back of a residential home, the employer failed to provide fall protection for an employee applying paint finish, approximately 11 feet 6 inch above ground level, exposing employee to a fall hazard.     b) 4630 Gloria Drive, Austell, Ga., On the front of a residential home, the employer failed to provide fall protection for an employee applying a paint finish, approximately 11 feet 1 inch above ground level, exposing employee to a fall hazard.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:  a) 4630 Gloria Drive, Austell, Ga., The employer failed to develop and implement a written respiratory protection program for users of a N-95 disposable respirator. Employees were exposed to materials such as, but not limited to, Sherwin Williams Dura Craft Exterior Acrylic Latex Flat Deep base paint and Siliconized Acrylic Siliconized sealant and other materials while performing spray paint operations and other assigned duties involving the painting of residential homes.
