29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: a) North side of loading rack: On or about February 21, 2013 and at times prior there to, the design and use of the raised walkway in the opening of the standard railing did not comply with the requirements of this standard in that there was no top rail which exposed employees to a fall of 13-feet. b) South side of loading rack: On or about February 21, 2013 and at times prior there to, the design and use of the raised walkway in the opening of the standard railing did not comply with the requirements of this standard in that there was no top rail which exposed employees to a fall of 13-feet.

29 CFR 1910.132(a): Protective equipment was not maintained in a sanitary and reliable condition: a) North side of loading rack: On or about February 21, 2013 and at times prior there to, the chain and round pin anchor shackles were not designed or reliable for use with a personal fall arrest system which exposed employees to falls up to 13-feet. b) South side of loading rack: On or about February 21, 2013 and at times prior there to, the chain and screw pin chain shackles were not designed or reliable for use with a personal fall arrest system which exposed employees to falls up to 13-feet.
